1.1 Nature of Service PureFinancialAcademy.com is an online educational website only, owned and operated by Pure Financial LLC (herein referred to as "PFA"). PFA provides training services and software products, including but not limited to audio, video, written materials, digital programs, digital files, licenses, courses, webinars, memberships, or subscriptions (herein referred to as "PFA Services or Software"). This Terms of Service is an agreement you must accept in order to use PFA Services or Software, INCLUDING THE BINDING ARBITRATION PROVISION CONTAINED IN SECTION 8. YOU MUST BE EIGHTEEN (18) OR OLDER TO ACCESS THIS SITE AND ANY MATERIAL PROVIDED BY PFA.
1.2 Information Sources and Accuracy Information contained throughout the site may be provided by sources that are not affiliated with PFA. The accuracy and reliability of such information is believed to be reliable. However, PFA does not warrant the accuracy, completeness, quality, adequacy, or content of any information on our website. Such information is provided 'as is' without warranty or condition of any kind, either expressed or implied.
1.3 Regulatory Status and Investment Disclaimer PFA is not a Commodity Trading Advisor (CTA) or a Registered Investment Advisor (RIA), or a broker-dealer. Trading has both potential risk and rewards. Any trades placed upon reliance on PFA Services or Software are taken at your own risk. Your account can be lost in its entirety at any time. Past performance is not necessarily an indication of future performance. PFA makes absolutely no guarantee or representation that any account will, or is likely to achieve profits or losses similar to those shown or discussed. All PFA Services or Software are not to be interpreted as investment advice. PFA may have positions in any asset class mentioned and is under no obligation to disclose details regarding any of their transactions.

1.6 Software Terms Some PFA Software has its own license agreement and risk disclosure, which you must accept before that software can be used (for example, CopySuite shows a Risk Disclosure and Terms of Use when it starts). You may read them before you purchase by contacting
2.1 Contact Information and Communications Consent You acknowledge that your contact information, including but not limited to name, email, and phone number will be stored in a database owned by PFA, and you agree to be contacted by PFA and its associates, including but not limited to by email, text, push notification and phone. You agree to receive notifications whether verbal, email, text, push, visual or by any other means which may contain content including but not limited to link(s) and code(s) that provide affiliate benefits such as monetary compensation and/or any other means to PFA by third parties. You agree that PFA may provide your contact information, in whole or in part, to Third-Party Presenters at the sole discretion of PFA and you agree to be contacted by such Third-Party Presenters.
3.1 Trade Alerts and Notifications All trade alerts, calls and or notifications whether verbal, email, text, push, visual or by any other means, are strictly for educational purposes only, and are not meant to be a solicitation or recommendation to buy, sell, or hold any securities or commodities including but not limited to futures, options, equities, or forex. All trades presented are not traded in a live account and should be considered hypothetical.
3.2 CFTC Rule 4.41 Disclosure HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER-OR-OVER COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFIT OR LOSSES SIMILAR TO THOSE SHOWN.
4.1 Prohibited Uses and Member Confidentiality You agree that you will not allow anyone else access to, nor will you attempt to copy or duplicate any PFA Services or Software without written permission from PFA. No member may communicate to non-members any PFA Services or Software or other information provided by PFA, or reveal PFA's view of or position in any asset class, without written permission from PFA. You agree that you will be solely responsible for any liability arising from any third party access including but not limited to financial responsibility.
5.1 Service Availability and Risk Any PFA Services or Software provided by PFA is used entirely at your own risk. PFA Services or Software is strictly for educational purposes only. PFA Services or Software should NOT be relied upon for any live trade decisions. PFA Software that places, modifies, cancels or closes orders in your trading accounts (for example, a trade copier) does so only as your own settings and actions direct, entirely at your own risk, and under its own terms (section 1.6). PFA makes no representation that the operation of the PFA Services or Software will be uninterrupted or error-free, and PFA will not be liable for the consequences of any interruptions or errors. All PFA Services or Software is provided 'as is' without warranty or condition of any kind, either expressed or implied.
5.2 Software Version Maintenance PFA is not responsible for maintaining any version(s) of software files with the exception of the most recent "current" version. You agree to be solely responsible for backing up any file(s) to which you hold an active license and accept that a newer version will NOT be provided by PFA without additional costs.
5.3 Lifetime License Definitions The term(s) "lifetime", "perpetual" and or "unlimited" are defined here as 'the amount of time the PFA Services or Software purchased remains available for purchase on the domain purefinancialacademy.com', and may be subject to change without notice. PFA MAKES NO GUARANTEE OR REPRESENTATION AS TO HOW LONG ANY PFA SERVICES OR SOFTWARE WILL BE OFFERED OR SUPPORTED.
5.4 Software Updates and Maintenance Software purchased with a "lifetime", "perpetual" and or "unlimited" license, includes free updates for a period of one (1) year from the purchase date. After the one (1) year period, update(s) will require a maintenance fee. The fee amount will be fifty (50) percent of the "then current" purchase price of the corresponding product. The completed maintenance fee payment will extend the software license, free update period, one (1) year from the payment date.
6.1 Remote Support Disclaimer If you require remote support at any time PFA holds no responsibility to any actions made on any computer at any time and can not be held liable in any way. By requesting or accepting a request from a PFA representative to give live remote assistance, you accept full responsibility for changes made to the computer content or system settings. PFA does not assume and is not responsible for any liability for the linking and viewing of any computer content. As such, PFA recommends you remain at your desktop and observe for the entirety of the session.
7.1 No Refunds Policy NO REFUNDS OR EXCHANGES ON ANY PURCHASES. Due to the immediate access to our online PFA Services or Software, there is a strict NO REFUNDS POLICY. PFA does not offer a refund nor an exchange for any reason. We encourage our guests to do their due diligence in order to make an educated decision, and we are happy to answer any questions you may have prior to making any purchase. If you wish to cancel your subscription at anytime, you can do so from within your User Profile (if applicable). Cancellations must take place a minimum of 24 hours before the beginning day of your billing cycle. You are responsible for cancellations and all payments that take place.
8.1 Comprehensive Risk Acknowledgment and Release YOU EXPRESSLY AGREE THAT YOU ARE FULLY AWARE OF THE RISKS ASSOCIATED WITH YOUR PARTICIPATION IN THE USE OF PFA SERVICES OR SOFTWARE, AND YOU ARE VOLUNTARILY PARTICIPATING ENTIRELY AT YOUR OWN RISK. IN CONSIDERATION OF RISK WHILE PARTICIPATING IN THE USE OF PFA SERVICES OR SOFTWARE, AND AS CONSIDERATION FOR THE RIGHT TO PARTICIPATE IN THE USE OF PFA SERVICES OR SOFTWARE, YOU HEREBY, FOR YOURSELF, YOUR HEIRS, EXECUTORS, ADMINISTRATORS, ASSIGNS, OR PERSONAL REPRESENTATIVES, KNOWINGLY AND VOLUNTARILY WAIVE ANY AND ALL RIGHTS, CLAIMS OR CAUSES OF ACTION OF ANY KIND WHATSOEVER ARISING OUT OF YOUR PARTICIPATION IN THE USE OF PFA SERVICES OR SOFTWARE, AND DO HEREBY RELEASE AND FOREVER DISCHARGE PFA, THEIR AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNS, FOR ANY PHYSICAL OR PSYCHOLOGICAL INJURY, INCLUDING BUT NOT LIMITED TO ILLNESS, DAMAGES, FINANCIAL OR EMOTIONAL LOSS, THAT YOU MAY SUFFER AS A DIRECT OR INDIRECT RESULT OF YOUR PARTICIPATION IN THE USE OF PFA SERVICES OR SOFTWARE.
8.2 Binding Arbitration and Class Action Waiver ANY DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING IN ANY WAY TO THESE TERMS, YOUR USE OF ANY PFA SERVICES OR SOFTWARE, OR ANY PRODUCTS SOLD OR DISTRIBUTED BY PFA OR THROUGH PUREFINANCIALACADEMY.COM, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY, WILL BE RESOLVED BY FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS, AND NOT IN COURT, EXCEPT THAT EITHER YOU OR PFA MAY BRING AN INDIVIDUAL CLAIM IN SMALL CLAIMS COURT, AND PFA MAY ASK A COURT TO PROTECT ITS INTELLECTUAL PROPERTY OR TO STOP A BREACH OF A SOFTWARE LICENSE. The arbitration will be administered by the American Arbitration Association under its rules then in force, before one arbitrator, seated in Atlanta, Georgia. The arbitrator decides every question about the scope, validity and enforceability of this section. YOU AND PFA EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION OR ARBITRATION.
8.3 Governing Law, Venue and Time to Bring a Claim These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules, and by the Federal Arbitration Act. ANY CLAIM, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY, MUST BE BROUGHT WITHIN ONE (1) YEAR AFTER IT AROSE, OR IT IS PERMANENTLY BARRED. A court action allowed by section 8.2, and any action to enforce an arbitration award, will be brought only in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of those courts. If any provision of these terms is held unenforceable, the remaining provisions will remain in full effect, except that if the class waiver in section 8.2 is held unenforceable for a claim, that claim will be heard in those courts and not in arbitration.
8.4 Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW, PFA AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS AND AFFILIATES WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE OF ANY KIND, INCLUDING, WITHOUT LIMITATION, TRADING LOSSES, LOST PROFITS, MISSED OPPORTUNITIES, FEES, AND ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, ARISING FROM OR RELATED TO ANY PFA SERVICES OR SOFTWARE, THEIR DOCUMENTATION, PFA'S SUPPORT, OR YOUR USE OF, OR INABILITY TO USE, ANY OF THEM, WHATEVER THE LEGAL THEORY (CONTRACT, WARRANTY, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY OR ANY OTHER), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WHERE LIABILITY CANNOT BE EXCLUDED, PFA'S TOTAL LIABILITY FOR ALL CLAIMS TOGETHER IS LIMITED TO THE AMOUNT YOU PAID TO PFA IN THE TWELVE (12) MONTHS BEFORE THE FIRST CLAIM AROSE. THESE LIMITS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
9.1 Terms Revision Rights We may revise these terms from time to time, the most current version will always be at purefinancialacademy.com/terms-and-conditions. If the revision, in our sole discretion, is material we will notify you via an email to the email associated with your account. PFA reserves the right to revoke your access to all PFA Services or Software if the terms set forth in these terms and conditions are breached, without refund or notice. By continuing to access or use PFA Services or Software after those revisions become effective, you agree to be bound by the revised terms. By accessing and or using PFA Services or Software, you are agreeing to all of the terms above and you accept full responsibility for your trading and investing results.
9.2 Other Terms and Order of Precedence These terms, the Refund Policy at purefinancialacademy.com/refund-policy, and the license agreement and risk disclosure of any PFA Software you use are read together as one agreement. Every disclaimer, release, exclusion and limitation of PFA's liability in any of them is in addition to the others and applies in full. Where they otherwise conflict about a PFA Software product, that product's risk disclosure (in the version you most recently accepted) applies first, then its license agreement, then these terms.
